What the new law does, is it allows those who re overtays ( they entered legally with a visa but overstayed after the visa expired) to be able to get a waiver HERE IN THE US, instead of waiting for months even years at their home country. Now you still have to eventually go to your countrie's consulate and get the final stamp there, but it will be like a weekend trip and with the knowledge that you are have an approved waiver.
I am disappointed with the USCIS though... It is not for other illegal immigrants, only the overstays. And it is not any more forgiving when it comes to the waiver standards. EXTREME HARDSHIP is still the standard that you have to prove to your relative ( wife, parent).
I guess at least we're moving in the same direction.
